Subpoenaed Identities: Medical Surveillance, EMR Policy, and Gender-Affirming Care — A Policy Review and Editorial

This project critically examines how electronic medical record (EMR) policies and data-sharing practices intersect with the privacy and safety of transgender and gender-diverse patients in the context of increasing legal subpoenas targeting medical identities. Through a review of current laws, health system policies, and case precedents, the work explores how medical surveillance mechanisms may compromise confidentiality in gender-affirming care. The editorial provides policy recommendations for protecting clinician–patient trust and institutional compliance amid evolving state and federal legal landscapes.
